An electronic signature (e-signature) is any electronic indication of intent to agree to a document. It's the digital equivalent of putting pen to paper.

Digital Signature: The Cryptographic Method

A digital signature is a specific type of electronic signature that uses cryptographic techniques (public key infrastructure, or PKI) to create a mathematically verifiable link between a signer and a document.

How it works:

  2. 2When signing, the private key creates a unique encrypted hash of the document

Both electronic and digital signatures are legally binding. The ESIGN Act (US) and eIDAS (EU) both recognize electronic signatures as legally valid without requiring the full cryptographic infrastructure of a digital signature.

The legal standard is about intent and consent, not the specific technology used. A properly executed electronic signature with an audit trail is just as enforceable as a digital signature for standard business documents.
